State investigators arrested Erik “N” and Shawna “N” during a search of a house in the Lagunitas 2 neighbourhood of Cabo San Lucas, and a federal judge later bound both over for trial.[1] Mexico’s Fiscalía General de la República (FGR), the federal prosecutor’s office, said its Baja California Sur office obtained that vinculación a proceso for probable drug offences and possession of cartridges reserved for the armed forces.[2] The Agencia Estatal de Investigación Criminal (AEIC), the state criminal investigation agency, made the arrests during the search and handed the two people and the seized items to the federal public prosecutor.[1]
The FGR said the search found 59 plants with the characteristics of marijuana, 231.9 grams of cannabis sativa L., 11.9 grams of seeds of the same plant, and a liquid containing delta-9-tetrahydrocannabinol (THC).[1] Officers also seized 39 boxes of vaporizers, lamps and other cultivation equipment, and 79 usable cartridges of various calibres.[1] Palabra BCS, reporting the same account, described the 231.9 grams as green and dried herb that tested as cannabis sativa L., and said the plants had green leaves of different sizes.[2]
A judge found the detention lawful and issued an auto de vinculación a proceso, an order binding both people over for trial, for sowing and cultivating marijuana, possessing cannabis for trade or supply, and possessing cartridges reserved for the armed forces.[1] The court imposed prisión preventiva oficiosa, mandatory pretrial detention, and set three months to close the complementary investigation.[3] The published FGR account says the two are presumed innocent until a court conviction.[2]
