Munawwar Hussain was acquitted by Nainital’s special NDPS court in a nearly seven-year-old case involving charas, a cannabis resin.[1] Additional District and Sessions Judge Sanjeev Kumar delivered the verdict on 3 November.[1] The court acquitted Hussain of the charge under sections 8/20 of the NDPS Act.[1] After acquitting him, the court cancelled his personal and bail bonds.[2]

Police said they caught motorcycle riders Munawwar Hussain and Mohammed Kamil during a check on Haidakhan Road in the Kathgodam police-station area on 12 February 2019.[1] Police claimed charas was recovered from both men.[1] A second account put the claimed recovery at about 1 kilogram.[3] Kamil died during the trial, and proceedings against him were closed on 6 December 2022.[3]

The court found no general-diary entry in the records showing that the police team had left the station.[1] Recovery and arrest documents contradicted one another; the investigator had not signed the checklist, and another document bore the signature of an officer who was not present at the scene.[1] No independent witness was included at the time of the alleged recovery.[1] The court also considered failure to follow mandatory safeguards under section 50 of the NDPS Act significant.[1] It treated the recovery as doubtful and found the prosecution had failed to prove the allegations beyond reasonable doubt.[1]
