Two men jailed 30 years and caned for 139 kg of cannabis

S. Mohan, 38, and Ahmad Shamil Abdul Rashid, 28, were sentenced to 30 years in prison and 12 strokes of the cane for trafficking 139 kg of cannabis from a Bangsar car park in 2022. The judge found the case proven beyond reasonable doubt; the prosecution had sought the heavy term over the quantity.

High Court judge Datuk Mohd Arief Emran Arifin sentenced S. Mohan, 38, and Ahmad Shamil Abdul Rashid, 28, to 30 years in prison and 12 strokes of the cane for trafficking 139 kilograms of cannabis four years ago.[1][2] The terms run from their arrest on 31 May 2022.[1][2]

The men were caught after police surveillance watched them move bags and plastic packets from a Toyota Vellfire into a Proton Preve at a shopping centre car park in Bangsar at 2pm that day; Ahmad Shamil tried to flee in the Vellfire but was caught nearby, and the cannabis, 139,019.3 grams, lay in the Preve’s rear passenger area.[1][2] They were charged under section 39B(1)(a) of the Dangerous Drugs Act 1952, which allows the death penalty or life imprisonment, with at least 12 strokes of the cane where death is not imposed.[1][2]

Deputy Public Prosecutor Zaileen Nadia Zubir asked for 30 years and caning, pointing to the quantity, while the defence sought the minimum, citing remorse and over four years already spent in custody.[1][2]
