Kerala High Court says cannabis in pots is still cultivation

On 4 November 2025 the Kerala High Court refused to quash a prosecution against a man who grew five cannabis plants in pots on a rented terrace in Thiruvananthapuram. The court held that ‘cannabis plant’ means any plant of the genus, whether or not it bears flowering tops, and that growing it in a pot is cultivation under sections 8(b) and 20(a).
